Buying Land in Northeast PA

Land is the one purchase where the questions matter more than the photos. Before you make an offer on a parcel, an agent should help you confirm the following:

  • Zoning and permitted use. The municipality’s zoning ordinance decides whether you can build a house, a second unit, a business or nothing at all, and what setbacks and minimum lot sizes apply.
  • Water and sewer. If public utilities do not reach the lot, you will need a well and an on-lot septic system, which requires a soil probe and percolation test approved by the township’s sewage enforcement officer. A lot that fails that test cannot be built on.
  • Access. Check the deeded road frontage or right-of-way. A driveway onto a state route needs a highway occupancy permit from PennDOT.
  • Wetlands and floodplain. Parcels near the Susquehanna, the Lehigh and their tributaries may carry floodplain or wetland restrictions that limit building.
  • Subsurface rights and easements. Mineral, gas and timber rights can be owned separately from the surface, and utility or pipeline easements can cross the parcel. A title search shows both.
  • Clean and Green. Larger parcels enrolled in Pennsylvania’s Clean and Green program carry lower assessments, but changing the use can trigger roll-back taxes for up to seven years.
