End User License Agreement

This End User License Agreement (“Agreement”) is between you and Button Real Estate (“we,” “us,” or “our”) and governs your use of the software features and data provided through buttonre.com (the “Site”), including the property search, saved searches and favorites, mortgage and affordability calculators, home-sale and valuation tools, and any downloadable materials (together, the “Services”). By using the Services you accept this Agreement. It supplements our Terms of Service, Privacy Policy, and Disclaimers; if this Agreement conflicts with the Terms of Service, the Terms of Service control.
1. License Grant
Subject to this Agreement, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to access and use the Services for the purpose of researching, buying, selling, or renting real estate for yourself or a household member. No other rights are granted, and all rights not expressly granted are reserved by Button Real Estate and its licensors.
2. Restrictions
You may not: (a) copy, modify, reverse engineer, or create derivative works of any part of the Services; (b) use automated tools, scripts, or bots to access, scrape, or download content or listing data; (c) sell, rent, sublicense, or otherwise commercialize the Services or any data obtained through them; (d) remove or alter any copyright, trademark, or proprietary notice; (e) use the Services to build a competing product or database; or (f) use the Services in any way that violates applicable law or the rules of the multiple listing service that supplies the listing data.
3. Listing Data
Property listing data is provided by one or more multiple listing services under the Internet Data Exchange (IDX) program and remains the property of the listing brokers and the MLS. It is licensed to you solely for your personal, non-commercial use to identify properties you may be interested in purchasing. Any other use is prohibited. The MLS and listing brokers may require us to suspend access to the data at any time.
4. Accounts, Saved Searches, and Favorites
Some features may let you save searches or mark properties as favorites. You are responsible for keeping any login details confidential and for all activity under your account. We may remove saved data or suspend accounts that are inactive, that violate this Agreement, or where required by the MLS.
5. Calculators and Tools
Calculators, valuation estimates, and similar tools are licensed for informational use only. Their results are estimates based on the figures you enter and general assumptions; they are not offers, appraisals, pre-approvals, or advice. See our Disclaimers.
6. Updates and Availability
We may modify, update, or discontinue any part of the Services at any time without notice. We do not guarantee that the Services will be available without interruption or error.
7. Ownership
The Services, including all software, design, text, graphics, and compilations (but excluding MLS listing data and third-party content), are owned by Button Real Estate or its licensors and are protected by United States and international intellectual-property laws. This Agreement licenses the Services to you; it does not sell them.
8. Termination
This license ends automatically if you breach this Agreement. We may also end it at any time by discontinuing the Services or notifying you. On termination you must stop using the Services and delete any content obtained through them.
9. Disclaimer and Limitation of Liability
The Services are provided “as is” without warranty of any kind. To the fullest extent permitted by law, Button Real Estate will not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Services. The warranty disclaimers and liability limits in our Terms of Service apply to this Agreement.
10. Governing Law
This Agreement is governed by the laws of the Commonwealth of Pennsylvania. Any dispute will be brought in the state or federal courts located in Luzerne County, Pennsylvania.
